  1. Incase of E-TDS return, whether filing of TDS return in electronic form is mandatory for all?

NO. e-filing of TDS return is mandatory only for corporates for AY 2003-04.
Non-corporates may/may not file TDS returns in electronic form.

What must accompany an e-TDS return?

An e-TDS return shall comprise of: -
A CD/Floppy with the soft file containing the details of the return and the bank details.
    Signed Copy of Form 27A
Photocopy of the Letter from ITD (incase where TAN is not available in database i.e. when new TAN has been allotted & it is not updated in database)

  2. Is return submitted under Form 24, Form 26 & Form 27 considered
a single return for one deductor?

NO. Each Form, say, 24 or 26 or 27, is to be considered as a separate return. Thus Form 24 shall be considered as a separate return, Form 26 separate & Form 27 separate even though the same belongs to the same (one) deductor.

  3. Is a TDS return same as an income-tax return?

NO. A TDS return simply gives details of the tax deducted at source by the deductor for various payments made by him during the last financial year. Income-tax return, on the other hand, contains comprehensive details about the total income earned, the various deductions eligible and the net income tax payable to ITD. Our scope of work in this project is limited to TDS returns.

  4. Briefly define e-TDS return and physical return?

"e-TDS return" means a return to be filed under Sec 206 of the Act duly supported by a declaration in Form No. 27A as prescribed under the Rules of the Income Tax Act, 1962 whereas "Physical Return" means filing of TDS returns in physical (paper) form.

  5. What is the due date to file the return?

As per notification # S.O. 974(E) dated 26.08.2003 the last date to file the TDS return for corporates is 31st January, 2004.
